These terms explain how the Inspired by Tyson website, online shop, custom work, customer content, and dispute process operate.

The agreement behind the work.

These Terms of Service (the “Terms”) are between you and Tyson Gill Inspired Furniture, LLC (“TGIF,” “Inspired by Tyson,” “we,” “us,” or “our”), a Wyoming limited liability company operated primarily from Miramar, Florida. They apply to InspiredByTyson.com, the online shop, quotes, custom furniture work, customer accounts, and related services.

01 · Agreement and eligibility

Using the site means accepting these terms.

By accessing the site, creating an account, requesting or approving a quote, or purchasing a product or service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site or place an order.

You must be at least 18 years old, or the age of legal majority where you live, and able to enter a binding contract. If you use the site for a business or another person, you represent that you have authority to bind them.

Order of control

If documents conflict, the following order generally applies to the specific subject: (1) a signed or expressly approved order-specific agreement, estimate, invoice, or specification; (2) the written Warranty, Shipping & Returns Policy for warranty, shipping, or returns issues; and (3) these Terms. Mandatory law controls over all of them.

Plain-language rule. A promise made in an approved order record is not replaced by a broader sentence on this page.

02 · Orders and estimates

An order is accepted when we confirm it.

Website listings, conversations, and estimates are invitations to order, not guarantees of acceptance. We may decline or cancel an order before acceptance for reasons such as material unavailability, an obvious pricing error, suspected fraud, shipping limitations, unsafe specifications, or inability to perform the work as requested. If we cancel after payment and no amount is lawfully due for work already authorized, we will refund the applicable amount.

Specifications

Dimensions, finishes, colors, accessories, delivery method, and timing should be confirmed in the product listing, order record, or written estimate.

Changes

A requested change may affect price, materials, and completion time. It becomes part of the order only after written confirmation.

Timing

Production and delivery dates are good-faith estimates unless we expressly agree in writing that a date is guaranteed.

Accuracy

You are responsible for checking names, measurements, delivery details, and approved specifications before production begins.

Product presentation

We work to present products accurately. Screen settings, lighting, wood grain, handmade construction, and material batches can create reasonable variations in color, texture, pattern, and measurements. These natural or customary variations are not automatically defects.

03 · Payments, pricing, and taxes

Payment terms appear before the work begins.

Prices are shown in U.S. dollars unless stated otherwise. Shipping, delivery, assembly, customization, taxes, and similar charges may be added before checkout or shown in an estimate. You authorize the payment provider to charge the method you select for the amounts displayed or otherwise approved.

Payment card and wallet information is processed by the applicable payment provider, such as Squarespace Payments, PayPal, Venmo, or another provider available at checkout. TGIF does not need to receive your full payment-card number to complete ordinary online transactions.

Deposits and balances

An estimate or invoice may require a deposit, staged payments, or payment in full. Unless the order record says otherwise, any remaining balance is due before shipment, delivery, pickup, or release of the completed product. We may pause work while an amount is overdue.

Pricing errors and chargebacks

If a price or product description contains an obvious error, we may correct it before acceptance and offer you the choice to proceed at the corrected terms or cancel. Before initiating a payment dispute or chargeback, please contact us so we can review the order and available remedy. This does not limit rights provided by your card issuer or applicable law.

04 · Custom and made-to-order work

Custom work depends on your approval.

Custom and made-to-order products may be produced from measurements, pet information, finish choices, reference images, intended use, and other details you provide. You represent that those details are accurate and that you have the right to provide any reference material.

Safety and intended use

Use products only for their described purpose, on a stable surface, within stated size or weight limits, and with appropriate supervision. Inspect products periodically and stop using an item that is damaged, unstable, improperly assembled, or used in a way that creates a foreseeable risk. Our content and products are not veterinary, medical, behavioral, engineering, or professional training advice.

05 · Shipping, pickup, and delivery

Delivery details must be workable and accurate.

Shipping and delivery options, charges, risk allocation, inspection deadlines, and claim procedures are described in the order record and our Warranty, Shipping & Returns Policy. You are responsible for providing an accurate address, safe access, a responsible recipient when required, and any building or property approvals needed for delivery.

Carrier delays, severe weather, supply interruptions, access problems, and events outside reasonable control may affect timing. We will communicate material delays when reasonably possible. Title and risk of loss transfer as stated in the written shipping policy, the order record, and applicable law.

Local pickup or delivery

For local pickup or arranged delivery, inspect the product when reasonably possible. If no one is available, access is unsafe, or the product cannot fit through the provided route, additional storage, return, redelivery, or handling charges may apply if disclosed and permitted by law.

06 · Cancellations, returns, and warranty

The written policy controls these remedies.

Our current Warranty, Shipping & Returns Policy is incorporated into these Terms. It explains eligibility, notice requirements, exclusions, and available remedies. If these Terms conflict with that policy about a warranty, shipping claim, return, cancellation, or order-specific remedy, the written policy or order-specific agreement controls.

Express warranty preserved. Nothing in these Terms eliminates an express written warranty or a consumer right that applicable law does not allow us to disclaim.

Because custom and made-to-order products may be difficult to resell, cancellation or return rights can be limited after materials are purchased, customization begins, or production is underway. Any applicable nonrefundable amount, restocking charge, or deduction will be stated in the order record or written policy and applied only as permitted by law.

07 · Site, accounts, and acceptable use

Use the site lawfully and respectfully.

You may use the site for personal or legitimate business purposes connected to TGIF products and services. You may not:

  • violate law or another person’s rights;
  • attempt to gain unauthorized access to an account, system, or nonpublic area;
  • introduce malicious code, scrape the site at a disruptive scale, or interfere with security or operation;
  • misrepresent identity, payment authority, measurements, intended use, or order information;
  • copy, resell, or exploit site content except as law allows or we authorize in writing; or
  • use the site to submit unlawful, infringing, threatening, deceptive, or harmful material.

If you create an account, keep the credentials confidential and notify us if you suspect unauthorized use. We may suspend access reasonably necessary to protect the site, users, TGIF, or legal compliance.

Third-party services

The site may link to or embed payment providers, review platforms, social networks, scheduling tools, maps, video, or other third-party services. Their own terms and privacy practices apply to their services. A link or integration does not make TGIF responsible for their independent conduct.

08 · Intellectual property, reviews, and customer content

Your content stays yours. Our work stays ours.

The site, TGIF branding, product photography, written content, graphics, page designs, and original materials are owned by TGIF or used with permission and are protected by applicable intellectual-property laws. These Terms give you a limited, revocable, nonexclusive right to use the site for its intended purpose; they do not transfer ownership.

Material you provide

You retain ownership of customer content you provide. You grant TGIF the limited rights reasonably necessary to review the material, communicate with you, perform the requested service, maintain records, and display material that you clearly submit for publication on the site. You represent that you have the necessary rights and that the material is not unlawful or infringing.

Reviews and testimonials

Reviews or ratings submitted to TGIF or posted publicly on a third-party review platform may be quoted, linked, or displayed with attribution where permitted by law and the platform’s terms. We will not use an identifiable customer photo, video, or testimonial in paid advertising or an unrelated promotional campaign without separate permission.

We do not condition incentives on a required positive sentiment, knowingly publish fake reviews, or suppress a review solely because it is negative. We may remove content that is unlawful, threatening, private, irrelevant, fraudulent, infringing, or otherwise violates these Terms.

Feedback

If you voluntarily send an idea or suggestion without a separate confidentiality agreement, we may consider and use it without an obligation to compensate you, but this does not transfer ownership of your photos, videos, testimonials, or other protected customer content.

09 · Disclaimers and limits of liability

Reasonable limits, subject to the law.

The site and general informational content are provided on an “as available” basis. We do not promise uninterrupted access, error-free operation, or that general content will fit every person, pet, property, or use. Product and service obligations remain governed by the approved order record and any express written warranty.

IMPORTANT: TO THE FULLEST EXTENT PERMITTED BY LAW, TGIF DISCLAIMS IMPLIED WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED. THIS DOES NOT DISCLAIM AN EXPRESS WRITTEN WARRANTY OR ANY WARRANTY OR CONSUMER RIGHT THAT APPLICABLE LAW MAKES NONWAIVABLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, TGIF WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS OR LOST DATA, ARISING FROM THE SITE, A PRODUCT, OR A SERVICE, EVEN IF THE POSSIBILITY WAS KNOWN. TGIF’S TOTAL LIABILITY FOR A CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE THAT DIRECTLY GAVE RISE TO THE CLAIM.

These limits do not apply where prohibited, including to liability that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions, so part of this section may not apply to you.

Indemnity for misuse

To the extent permitted by law, you will be responsible for losses and reasonable costs arising from your unlawful misuse of the site, your material breach of these Terms, or content you provide that infringes another person’s rights. This does not require a consumer to indemnify TGIF for TGIF’s own negligence or unlawful conduct.

10 · Governing law, informal resolution, and arbitration

Most disputes begin with a direct conversation.

Read this section carefully. It includes an agreement to individual arbitration and a waiver of jury and class proceedings, but preserves qualifying small-claims cases and gives you 30 days to opt out of arbitration.

Governing law

Florida law governs these Terms and any dispute, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement to the extent it applies. Mandatory consumer law in your home jurisdiction remains applicable when it cannot lawfully be waived.

Thirty-day informal resolution

Before starting arbitration, the claimant must send a written notice to info@inspiredbytyson.com that includes the claimant’s name and contact information, relevant order or account information, a description of the dispute, and the requested relief. The parties will have 30 days from receipt to try in good faith to resolve the matter. A limitations period is tolled during that 30-day period to the extent permitted by law.

Small claims option

Either party may bring an individual claim in a small-claims court with jurisdiction instead of arbitration, as long as the claim remains only in that court and proceeds only on an individual basis.

Individual AAA arbitration

If the dispute is not resolved informally and is not brought in small claims, either party may require final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitrator may award any individual remedy available in court that is necessary to resolve the claimant’s individual claim. Judgment on an award may be entered in a court with jurisdiction.

The arbitration may proceed by documents, telephone, video, or an in-person hearing in Broward County, Florida, as the AAA rules, the arbitrator, and applicable law permit. Fees will be allocated under the AAA Consumer Arbitration Rules and fee schedule. TGIF will pay fees that those rules require the business to pay. If AAA is unavailable and the parties cannot agree on a substitute, a court may appoint an arbitrator as permitted by law.

No class or jury proceedings

DISPUTES MUST PROCEED ONLY ON AN INDIVIDUAL BASIS. NEITHER PARTY MAY SEEK TO HAVE A CLAIM HEARD AS A CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION. EACH PARTY WAIVES A JURY TRIAL FOR A DISPUTE SUBJECT TO ARBITRATION.

Thirty-day arbitration opt-out

You may opt out of this arbitration agreement by emailing info@inspiredbytyson.com within 30 days after you first accept these Terms. Use the subject “Arbitration Opt-Out” and include your full name, the email used for the order or account, relevant order information if available, and a clear statement that you are opting out of arbitration. Opting out will not affect the remaining Terms or your ability to purchase from TGIF.

Court venue and severability

For a dispute not subject to arbitration or small claims, the parties consent to exclusive jurisdiction and venue in the state or federal courts located in Broward County, Florida, unless applicable law requires another forum. If a part of this dispute section is unenforceable, it will be severed or narrowed to the minimum extent necessary, and the remainder will continue, except that a claim that cannot lawfully be arbitrated on an individual basis will proceed in court.

11 · Changes and general terms

The practical details.

Changes to these Terms

We may update these Terms when our services, business practices, providers, or legal obligations change. The “Last updated” date identifies the current version. A material change will apply prospectively, and we will provide additional notice when required. An order already accepted remains governed by the terms and order documents applicable when it was accepted, unless the parties agree otherwise or law requires a change.

Electronic communications

You agree that order confirmations, invoices, policy notices, and other transaction communications may be provided electronically. Marketing email remains subject to separate consent and unsubscribe rights.

Events outside reasonable control

Neither party is responsible for delay caused by events outside reasonable control, such as severe weather, carrier interruption, fire, labor disruption, government action, supply shortage, utility or network failure, or similar events. Payment obligations already due and rights that can reasonably be performed are not excused.

Assignment, waiver, and severability

You may not transfer an order or these Terms without our written consent if the transfer would materially affect performance. TGIF may assign these Terms in connection with a merger, reorganization, sale, or transfer of the relevant business, subject to applicable law. A failure to enforce a term is not a waiver. If a term is unenforceable, it will be narrowed or severed while the remainder stays effective.

Entire agreement

These Terms, the Privacy Policy, the Warranty, Shipping & Returns Policy, and any approved order-specific documents are the entire agreement about their subject matter and replace earlier discussions on that subject, except for a written agreement the parties expressly preserve.
